  1. Our Commitment To Privacy
  2. Your privacy is important to AllenPort Co. (“we” or “us”). We are committed to providing you with notice and choice about the use and any onward transfer of your personal information, as well as access to your personal information. We also take security, data integrity, and the enforcement of this privacy policy very seriously. To better protect your privacy we provide this notice explaining our online privacy practices and the choices you can make about the way your personal information is collected and used through our website or through services provided under our Subscription & License Agreement (“Services”). To make this notice easy to find, we make it available on our homepage and other convenient places.

  3. The Information We Collect
    1. Generally.   Except as otherwise stated herein, this notice applies to (1) information collected or submitted through the AllenPort website (the “Site”) and (2) information collected from paid subscribers and those designated users permitted to access a particular subscriber’s account (collectively, “Account Users”) via the Services. Regardless of whether you are an Account User who uses the Services to store or access text, images, sounds or other information (“Personal Digital Assets”) in an account-specific file known as a “Virtual File Cabinet,“ in order to activate a subscription or respond to your request for information we will collect certain information from you, including, for example, your name, address, email address, phone number, and age.

    2. Website Visitors.  Like many websites, the Site may collect information about visitors and the manner in which visitors utilize and navigate the Site. This information helps us to design the Site to better suit our visitors’ needs. For example, the Site may track the URL that you visited before you came to the Site, the URL to which you next go, as well as your IP address, browser type, internet service provider, operating system, language preference, clickstream data, and the date and time of each request. We may use this non-personally identifying information to help diagnose problems with our server, administer the Site or Services, or create a profile or log of your preferences, but we do not link information in this file to any of your personally identifying information which we may have. However, if you are also an Account User, such information may also be used to help identify you, to enforce compliance with the Subscription & License Agreement, and to gather broad demographic information.

    3. Account Users.  If you are an Account User, we will record data regarding your account-related activities, kinds of data files you store, and account details. This may include credit card or other billing information. And like many client server services, our Services contain features that automatically report to us, or permit Account Users to report to us, information about the efficiency or effectiveness of our Services. The logs generated by these features typically include non-personally identifying information, such as the replication status of a particular Account User session when the session closed (e.g., full replicated or partially replicated), but may include a limited amount of personal information. Although these logs may also provide us with the names of directories and files that were in use at the time of a system error, the logs never disclose any of the Personal Digital Assets in your Virtual File Cabinet. AllenPort analyzes the information provided by these interactive product features to develop a better understanding of how its Services are performing and being used, and to help us troubleshoot the cause of errors.

  4. The Use of Cookies and Clear GIFs
  5. Cookies are pieces of information that a website transfers to a user’s hard drive for record-keeping purposes while visiting a site. Like most websites, we may use cookies on certain pages of the Site. Cookies make using the Internet easier by, among other things, saving your passwords and preferences for you. We may also use cookies to identify and track Site visitors, and deliver content specific to your interests. Our cookies do not contain any personally identifiable information, although cookies may enable us to relate your use of our Site to personally identifiable information that you previously submitted.

    Most browsers are initially set to accept cookies, although your browser may permit you to decline our cookies. For information on configuring your browser to decline cookies, refer to your browser’s “help” feature. If you decline our cookies, your use of our Site and Services may be slowed because you may need to re-enter information; however, all services will still be available to you.

    We may also use clear gifs, which are tiny graphics with a unique identifier that tracks online movements of website visitors and informs us what content on our Site is most effective. Clear gifs are embedded invisibly on web pages and HTML-based emails. We do not tie the information gathered by website clear gifs to our customers' personally identifiable information, although we may link that information to your IP address. However, if you are an Account User, we may tie clear gifs to personally identifiable information when you enter the database – although in that case the connection is through a secure link and the data is encrypted.

    We may also use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications.

  6. How We Use Information
  7. We generally use personally identifiable information collected from Account Users or Site visitors for internal purposes such as fulfilling your requests for products, services or information, billing, promotion, customer support, responding to your inquiries, compiling usage statistics regarding the Site, and analyzing visitor preferences regarding our services. We may also use such information to verify your identity and to contact you for feedback on our products and services. Email correspondence and telephone calls to us may be monitored and/or stored to track reported problems, to service your needs, and for quality assurance purposes. If you provide us with billing account details of a third party, we may disclose your name and address, and data relating to payments made under that account to that third party. Otherwise, we will share personally identifiable information with outside parties only to the extent necessary to fulfill your requests for information or to provide our products and services to you. In such instances, the party with whom we share information will be bound to provide at least the same level of protection as this privacy policy offers. We may share non-identifying and/or aggregate information regarding popularity and usage of our various services with others, including but not limited to web designers and advertisers. For example, we may tell an advertiser that X number of individuals visited a certain area on our website, or that Y number of men and Z number of women filled out our registration form, but we would not identify those individuals.

    We use the information provided by Account Users in order to create Services that can offer a secure mobile environment for important Personal Digital Assets. If you subscribe to the Services, you will receive notice of updates to our software, along with important information about our products and services. Those notices will be delivered via email, and may include non-critical updates and notices from AllenPort Co. regarding special options or incentives. HOWEVER, ALLENPORT CO. DOES NOT AND WILL NOT SELL YOUR EMAIL ADDRESS TO ANYONE. We will only access Personal Digital Assets in your Virtual File Cabinet in order to fulfill a request by you or as necessary to correct a technical problem.

    In addition, in the event that AllenPort Co. or substantially all of its assets are acquired or reorganized, Account User and Site visitor information will of course be among the transferred assets; provided that the transferee agrees to comply with the provisions of this privacy policy. With the exception of Personal Digital Assets placed by a subscriber in a Virtual File Cabinet, AllenPort Co. is the sole owner of any and all information collected through the use of the Site and/or Services.

    If you are an Account User, we will retain your Personal Digital Assets only as long as is necessary for the purposes to which you consent under the Subscription & License Agreement, or as required by applicable law, and then we will delete it. However, we may retain certain personally identifiable information other than the Personal Digital Assets in your Virtual File Cabinet. For example, we may retain your billing account's credit card number for an unlimited period after the cancellation of your membership for fraud prevention purposes, but only in a generic form which does not identify you. And we will retain information so that we can reach you after your subscription has expired or terminated.

    Notwithstanding anything to the contrary in this policy, we may access the account of any Account User to verify that an account is not being misused and may divulge personally identifiable information and/or the Account User’s encrypted Personal Digital Assets to law enforcement agencies or other governmental agencies when required to do so or when we in good faith believe it is necessary in order to comply with legal obligations. We will, however, ask all governmental officials to provide us with acceptable reasons that we believe, in our sole discretion, support disclosure of personal information. We reserve the right to remove, disable, or block access to any Virtual File Cabinet and/or any Personal Digital Asset files or other files which we reasonably believe violate the law or legal rights of others.

    Finally, we will not use or share your personal information in ways incompatible with the purposes described in this policy without first obtaining your permission.

  8. How to Access or Correct Your Information

While anyone may visit the Site, please note that if you do not consent to the Subscription & License Agreement, sign up for the Services, and provide a password, you will not be able to use our Services. Account administrators may view, correct or update the account information in our database that was provided by them by logging in to this website and visiting the "My Account" page. We may retain in our backup or inactive files the uncorrected or outdated form of data that is corrected or updated in our active files. Such data may be retained for several reasons, including technical constraints, dispute resolution purposes, troubleshooting and enforcement of agreements.

    If we use any of your personally identifiable information or Personal Digital Assets in a manner that you believe is inconsistent with this privacy policy, please notify us immediately by sending an email to membership@allenport.com. Your only remedies in any such case are to ask us to correct such inconsistency or to terminate your subscription as provided in the Subscription & License Agreement.

  10. Linked Sites
  11. This privacy policy only addresses the use and disclosure of information we collect from you. Although you may link to other sites or third parties via the Site, we are not responsible for the privacy practices of third parties or the content of linked sites.

  12. Our Commitment To Data Security

To prevent unauthorized access, maintain data integrity and accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. However, you should keep in mind that the Site and Services are run on software, hardware and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security.

  14. Updates to this Policy
  15. From time to time, we may make changes to our information practices or alter the functionality of the Site and Services by amending this privacy policy and notifying you by email that you should review the revised policy by checking the Site. You agree that such notice is deemed received by you when mailed to such email address, whether or not you have actually read or received the notice. This privacy policy may not otherwise be amended except in a writing signed by both parties. If you do not agree with the modified terms to the privacy policy, your only recourse is to terminate your subscription, if applicable, or discontinue use of the Site. Upon termination of your subscription, you must cease participation in our Services. We encourage you to periodically review this page for the latest information on our privacy practices.
